A report by former Special Counsel Jack Smith, released by U.S. media on Tuesday, claims that Donald Trump, the President-elect, would have faced conviction for his alleged attempts to overturn the 2020 election results if he had not been re-elected four years later.

The report emphasizes the U.S. Department of Justice’s position that the Constitution prevents the indictment and prosecution of a sitting President. This stance is firm and remains unaffected by the severity of the alleged crimes, the strength of the evidence, or the merits of the case, which the Office fully supports.

According to the report, “Indeed, if not for Mr. Trump’s election and anticipated return to the Presidency, the (Special Counsel’s) Office concluded that the admissible evidence was adequate to secure a conviction at trial.”

DAILY POST reports that Trump, who is expected to return to the White House on January 20, faces accusations including conspiracy to defraud the United States and conspiracy to obstruct an official proceeding. This pertains to the Congressional session aimed at certifying President Joe Biden’s election victory, which was violently disrupted on January 6, 2021, by a mob of Trump’s supporters.

It was noted that Smith, appointed as Special Counsel to probe Trump, withdrew the federal criminal case against the incoming leader following his victory in November’s presidential election.

In response to the report’s release, Trump took to his Truth Social platform, labeling Smith as “deranged” and alleging that he failed to successfully prosecute the political rival of his superior.

“To illustrate how desperate Deranged Jack Smith is, he unveiled his false findings at 1:00 A.M.,” Trump remarked in another post.

Judge Aileen Cannon, a Trump appointee, dismissed a separate case against the former and future President concerning his handling of classified documents after leaving the White House. However, charges remain pending against two of his former co-defendants.

DAILY POST notes that Smith departed from the Justice Department last week, shortly after submitting his final report as Special Counsel.
